PML Press Release – Gilgit-Baltistan (GB) Elections 2009

1. PML only opposition party and thus raised issue of pre-poll rigging months back with evidence to PM, NA Standing Committee KANA Chairman and CEC GB.
2. PML Incharge GB gave complaints in writing to CEC GB on day of polling but none of the rigging evidences were rectified. With the result PML lost its strong seats to PPP, and PMLN due to massive rigging.
3. Some examples of type of rigging done on strong seats of PML
GBLA 7: Skurdu 1 (Vazir Vilayat) vs PPP
• 1 person voting in atleast 3 wards due to electoral roll inaccuracies.
• Challenge votes by PML not being accepted by administration.

• Physical violence by PPP against PML workers.

GBLA 10: Skurdu 4 Rondu (Capt Sikander) vs PPP

• Major Ijaz of Northern Scout involved in administrative action against PML, along with Tehsildar Iqbal
• 40 PML workers rounded up who were polling agents 2 days before elections which negatively impacted results.
GBLA 23: Ghanche 2 (Amina Ansari) vs PMLN
• Amina stoned by PMLN candidate men days before election and on polling day young girl polling agents of PML stoned as well to create fear.
• DC Khaplu Syed Hadi used state machinery against PML, including his clerk who had been posted out but performed counting duties Jabbar and Shabbir.
• Chuchkun, Ghopki, hachi, Denis, Kuwas need re-polling since many irregularities here due to manhandling of PML polling agents.
• Polling carried out at 11.30pm and boxes lost and not returned.

• Visit of Governor (opening of already open DHQ) and Minister Alamgir to coerce votes in favour of PPP the night before.

Pakistan Muslim League Press Release Gilgit-Baltistan Election Results 2009

Pakistan Muslim League is Pakistan’s only real opposition. As such in the Gilgit-Baltistan Elections 2009 it played an important role in identifying electoral system failures. Many types of interference were noted in the elections as is the norm in Pakistani politics. Most notable are the bureaucratic administrative pressures orchestrated by PPP Government. Pakistan Muslim League is the only party who gave evidence of pre-poll rigging couple of months prior to elections. These were presented to Prime Minister of Pakistan, Chairman National Assembly Standing Committee on Kashmir Affairs and Northern Areas and Chief Election Commissioner Gilgit-Baltistan. Despite these efforts none of the pre-poll rigging issues were rectified by government.

A- Pre-poll rigging: Here is the list of evidence presented by PML on pre-poll rigging:

1. There has been no dramatic demographic changes in Gilgit-Baltistan region since 2004, so why did the Election Commission order new Electoral Lists and spent only 18 days making them? There are many issues with these new Electoral Lists, they are typed and handwritten and it has increased the chances of voter list doubling and Ghost Voters. The doubling of voters will be the prime factor for massive rigging on the day of the elections.

2. Returning Officers and other polling staff have not been trained to distinguish between fake and original NIC to stop likely double use on Election Day and this has not been included in the polling staff training manual.

3. Photocopying of Postal ballot papers has been still going on. PML demands that November 11th be the last day for announcing postal ballot results to avoid rigging.

4. PPP govt deliberately stopped Gilgit-Baltistan ADP for one and half year and announced development schemes weeks before elections to change likely elections results.

5. According to election rules there should be no posting and transferring in the period 6 months to elections but PPP led govt did massive posting and transferring to rig elections she pointed out.

6. Issue of BISP cards was raised before and investigation of PM Secretariat proved that unlike other parts of Pakistan 36,000 cards out of 50,000 cards were distributed through non elected people, mostly through PPP members in Gilgit-Baltistan. Govt officials are distributing Baitul-Mal cards and Benazir Health Cards.

7. Sitting Governor and Federal ministers are running PPP campaign in Gilgit-Baltistan Region, Chief Minister Punjab also visited Gilgit-Baltistan Region, which is against 1977 Election Rules.

8. PML demands polling consolidation forms should be signed by polling agents and Statement of Account should be immediately made public after announcement of result.

9. PML candidates complained that the list of polling station was still not been completed and made public.

10. Rs.26000 is demanded for electoral rolls but sill many candidates have been complaining they did not receive them on time.

On November 12, 2009 Election day, Pakistan Muslim League Election Cell kept intimating the CEC of the rigging efforts being made by Government and other parties. Following is the list of complaints launched with CEC.

B- Poll day rigging:

1. Male and Female polling staff at Darqchun Khapplu GBLA 23 Ghanche 2 are involved in rigging, they are stamping the votes themselves in favor of PPP candidate. PML Polling Agents are not allowed to monitor polling there.

2. Polling staff at Boys High Schools Gupis and DJ Diamond Jubilee High Schools Gupis involved in rigging and harassing people to cast votes in favor of PPP candidate.

3. DC Khaplu actively involved in pushing Mufti vote stamping and allowing PML candidate pollinga gents to be physically pushed around including women being stoned.

4. PPP workers are not allowing PML Polling Agents to monitor polling in Bunji Astore.

5. At different polling stations of Ghanche 23 PS 17 voters have been allowed to use photocopied NICs.

6. Media and polling agents of PML are not allowed to monitor elections at GBLA 14 Astore 2 Finah. Returning Officers are not visiting polling stations even though candidates have phoned them several times.

7. In Ghanche GBLA 23 Siari polling staff is not allowing PML voters serial numbers 533 to 621 to cast their votes as their names are crossed and they are sent to Choar but their names are not registered in Choar.

8. PMLN workers flattened PML vehicles on order of DC to stop them picking up their voters in Ghanche GBLA 23.

9. PML workers have been stoned at Skardu 1 ward 2 women polling station when they tried to stop PPP workers from rigging. Five PML workers are injured.

10. No polling at GBLA 23 Ghanche 2 polling station number 48 since 1pm as PMLN workers and Mufti Abdulla Group forcefully closed down polling station.

11. MQM workers took over polling stations at Sultanabad and Muhammadabad schools in Denyor.

12. Vote doubling in Sikkar Gilgit 2.

13. Triple voting in Jalabad Denyor Gilgit 3.

14. Polling restarted by 7pm in Gilgit Jalabad to disturb PML candidate results.

15. Polling continued in Boys High School Gupis and Girl High School Gupis Polling Stations by 9pm PML workers being kidnapped, Vehicle no GLT 3000 torched by PPP workers in Khalti Lake area.

16. PPP workers took away ballot boxes from Jalabad High School Polling Stations by 7:00pm they also injured polling staff there.

17. PPP workers reopened Sumair Polling station Nagar 12 by 7:30pm.

18. Polling restarted by 7:15pm in Gilgit 2 Jalabad Denyor.

19. In GBLA 3 Ballot Boxes are missing from High School Denyor. At Oshkandas Dispensary polling station polling continued till 11:30pm. Jutialpine School, result announced from private house, re-polling is requested in these polling stations.

20. In GBLA 23 two polling officers Masroor and Abdullah who had to report to returining officers Khaplu are still missing at 11:45pm.

21. Massive rigging took place GNLA 10 Astuk and Trumbuk polling stations in Rondu, therefore it is requested that there should be re-polling and re-counting in these polling stations. Northern Areas Major Ijaz was activiely participating in supporting PPP candidate and was involved in ordering manhandling of PML polling agents.

22. Massive rigging took place in Chaqean, Braqchan, Thaqskong, Lasar, Hatci, Denis and Kowas polling stations of GBLA 23 Halka 2 polling stations as polling agents of PML were made hostage therefore it is requested that there should be immediate re-polling and re-counting in these polling stations.

23. Even though CEC ordered re-polling in Nursery Building Aushkandas, SAP school Muhammadabad, Govt High school Danyor and Jutalpaeen female polling station but re-polling was not done on these polling stations, therefore it is requested that there should be re-polling there.

In addition to the above, Pakistan Muslim League confirms that all observations made by FAFEN are correct. Here is the list of FAFEN observations.

C- FAFEN observations

 1. Erroneous Voter Lists: Erroneous or missing entries on the Voter Lists remained one of the major issues at most polling stations across Gilgit-Baltistan. These issues arose due to clerical errors, missing names of voters, wrong parentage, etc. At some polling stations (such as Boys High School , Jagir Basin in GBLA-1) scuffles broke out between agents of opposing candidates and polling staff because of problems with the voter lists. At Jagir Basin , the Assistant Election Commissioner had to intervene and appeal to voters to stay calm.

2. The Voter Lists were prepared in haste in only 18 days in September 2009, followed by a week-long Display Period to allow public scrutiny, and were sub-standard. People of age 18 or above were not required to possess Computerized National Identity Cards (CNICs) for registration as voters, although they would be required to show their CNICs to vote. The ECGB was aware of the errors and mistakes in the voter lists and had therefore allowed the Typed as well Enumerator’s Copy of the Rolls to be available at the polling stations for the Election Day. Nevertheless, there were significant problems on Election Day because of the flawed lists.

3. Procedural Irregularities Rules for various steps of voting and counting remain vague and unclear to polling officials, which led to irregularities that had implications for the quality of the election. Some major irregularities included:

4. Requiring Voters to Sign Ballot Receipts: Many polling officials did not understand that voters should put their thumb mark on the ballot paper counterfoil (receipt). Instead, at many polling stations voters were being asked to sign their names on the ballot counterfoil, which interferes with voting secrecy.

5. Too Few Booths for Voters: At many polling stations, polling officials set up only one booth despite a high number of voters, slowing down voting. FAFEN observers in Ghanche reported that at many polling stations, all required staff did not turn up, causing chaos and delay as voters had to wait much longer than would have been the case if more booths had been set up.

6. Voting Secrecy Compromised: The right of voters to stamp their ballots in complete secrecy was breached, particularly at female polling stations, where FAFEN observers reported that women voters were stamping their ballots in front of polling officers.

7. Photocopies of CNICs Accepted: Polling officers were also not trained to distinguish between photocopy and original Computer National Identity Cards (CNICs). At many polling stations, FAFEN observers saw polling officials allowing voters to cast ballots if they only had color photo copies of CNICs, rather than the original, which is contrary to the election law. This flaw in the procedures might have allowed many fake voters to cast votes using photocopies of CNICs.

8. Before Election Day, FAFEN observers reported that polling officials had varied interpretations of clear instructions from the ECGB that CNICs were required for voting, notified by the CEC on November 5, 2009. Just one day before elections, FAFEN observers in Skardu reported that the DEC said the token for the CNIC is admissible proof of identity for voting.

9. Indelible Ink not Applied: FAFEN observers noted that indelible ink was not being applied on every voter’s thumb, especially at female polling stations, as required by election procedures.

10. Police in Polling Booths: Police officers were standing inside the polling booths where ballot papers were being issued, according to FAFEN observer reports.

11. Closing Polling Early: At many polling stations, particularly in Skardu and Ghizer, polling officers counted the ballots before the close of the official voting time period, which is contrary to election procedures and disenfranchises potential voters who might still have arrived before the stipulated polling station closing time.

12. Obstructing Election Observers: Polling officials were also not clear about the kind of cooperation they were required to offer to independent election observers. At many polling stations, FAFEN observers were stopped from entering either by security or polling officials on the pretext that the Election Commission of Gilgit-Baltistan (ECGB) Accreditation Card was not sufficient and that observers required a letter from the Deputy Commissioner.

13. Unauthorized People in Booths: Polling officers also did not keep control on the movement of unauthorized persons inside polling stations, according to many FAFEN observers. The presence of persons other than voters, polling staff and accredited political party agents inside polling places is contrary to election law and has the potential to intimidate voters and prevent people from voting freely. In some polling stations, unauthorized persons and agents were also seen watching voters stamping their ballots.

14. Election Administration: Elections to Gilgit-Baltistan Legislative Assembly were held under Gilgit-Baltistan Legislative Assembly (Elections) Order 1975 (Amended up to 2009). The primary responsibility for the conduct of elections lies with the Election Commission of Gilgit-Baltistan (ECGB) headed by the Chief Election Commissioner (CEC), who was appointed less than a month before the elections. The following are some of the issues that must be addressed before the next elections in Gilgit-Baltistan.

15. Vague Electoral Procedures: Electoral rules pertaining to preparation of Voter Lists, election complaints, role of government, voting and counting, and consolidation of votes need to be clarified in order to enhance enforcement and ensure equitable implementation of all election rules.

16. Understaffed ECGB: The ECGB is under-staffed and lacks financial and technical resources to carry out the electoral exercise in 23 constituencies on short notice. With 13 staff, including support staff, and un-defined management structure, the ECGB had to rely on the assistance of government officials to conduct the elections. The Deputy Election Commissioner, who had been supervising the election administration, was posted out as Deputy Commissioner of Hunza, leaving the important position vacant at a critical stage two days before elections. Deputy Commissioners have been co-opted to act as District Election Commissioners (DECs) without being under the direct supervision of the CEC, compromising uniform implementation of the election law.

17. Shifting Polling Stations: Despite publication of the list of polling stations by the ECGB, election authorities at district level shifted the venues of polling stations a night before elections. Reports from Sihgar area of Skardu, Diamer and Gilgit suggested such last minute changes in the venues of some polling stations. The last minute changes are against the election law, cause problems for voters and candidates, and raise questions about the motives of such changes.

18. Absence of Polling Schemes: The ECGB did not release the polling schemes, which also include the names of polling staff to be deputed at various polling stations. As a result, candidates from almost all constituencies reported to FAFEN that polling officials were being changed until a day before elections. While such changes are occasionally necessary, they are contrary to election procedures and compromise the integrity of the process.

19. Mismanaged Postal Ballots: Despite assurances to FAFEN by the ECGB, the number of postal ballots issued and received before elections were not made public before the Election Day. There were also confusions about the procedures and deadline for casting postal ballots, leading to arguments at the offices of many Returning Officers. Postal ballots can change the results of elections and must be handled according to official procedures in order to count every vote and protect the process.

20. Government Interference: Despite legal restrictions on the use of state and government resources in favor of a party or a candidate in any election, functionaries of the federal government, including the Prime Minister and more than 10 other Ministers, not only campaigned for the Pakistan People’s Party (PPP), but also used state resources and authority to make policy-decisions that had election implications.

21. Promises of development funds and schemes, incentives to government employees, and announcement of administrative up-gradation of remote areas supported the election campaign of candidates fielded by the PPP in 23 constituencies of seven districts, creating un-level playing field for other political contestants. The Prime Minister’s public speech in Skardu two days before elections was a clear case of political influence over the vote in favor of his party’s candidates.

22. Similarly, Baitul Maal and Benazir Income Support Program Funds were used by candidates of a party to woo voters. Hundreds of thousands of forms for these programs, in original and photocopies, were found circulating in Gilgit-Baltistan during the election campaign. 3

23. Senior leaders from Punjab and NWFP governments also used official resources to travel and campaign for the candidates of their respective parties. The Governor also sided with the candidates of his party at a time when he had the official responsibility to protect the neutrality of the elections.

 Pakistan Muslim League confirms that Gilgit-Baltistan Elections 2009 were the most rigged elections of the history of Pakistan. However, since PML is a democratic party, it will continue to work within the failed system in order to improve it. It will be proposing massive electoral reforms and legislation in the National Assembly. Pakistan Muslim League remains committed to Gilgit-Baltistan progress with a two point agenda of devolution and development. It will continue to work for the people of Gilgit-Baltistan since it has won the hearts and minds of the people of Gilgit-Baltistan if not the adequate deserved seats in Gilgit-Baltistan Legislative Assembly.

The voices of the people of Gilgit Baltistan were nuzzled and they were robbed of their elected mandate in these elections. PML stands committed to bringing the real voices of the people of GB to national politics.

Deputy Speaker: Marvi Memon on point of order.

Marvi Memon: Bismilla-hir-rehman-nir-raheem, thank you very much Honorable Mr. Speaker. I would like to take divert your attention toward a very serious issue and that is pre-poll rigging in Gilgit-Baltistan, PPP with the help of administration is guilty of it. All National Bank defaulters belonging to PPP have been declared eligible for contesting elections. National Bank, SME Loan and Karakurm Cooperative Bank have declared them eligible, PMLN candidates also declared eligible. But our candidates who are not defaulters their names were put in this list and are disqualified. This is a very serious issue. As have already pointed out early, Benazir Income Support Forms are being wrongly used. NIC cards are being first kept and then disbursement has been done. This is totally unacceptable the way Benazir Income Support Program Funds have been given through the NGOs versus the elected representatives, Prime Minister has done investigation in this regard and we have his letter. ADP was halted for one and half year and now at the end it is released. This is also against the elections rule 1997 and we would like to consider this too. All posting and transfers orders given within 6 months should be taken back.  We have a long list and we would like to have detailed debate on this. We have also submitted adjournment motion on it and we want it to be taken up for the discussion. This is the request. Pre-poll rigging which has been started in Gilgit-Baltistan Pakistan Muslim League takes great exception to it and we want it to be discussed next week as early as possible. Thank you.

Marvi Memon: Bismilla-hir-rehman-nir-raheem, thank you Chairperson. Today I can say with the feeling of pride that Pakistan Muslim League is the single party which has taken principle stand against Kerry-Lugar Bill, its not today that we have taken such stand rather it has been since May and we have given our response in writing to US officials, Pakistani officials, higher officials media and everywhere, its not a new thing for us. I would like to say that Pakistan and its defense is our first priority and nuclear program is the essential part of our defense, we will not put up with any interference in our nuclear program. When it comes to our nuclear program we should be united as one to defend it and there should be no political scoring on it. There should be no civil military divide on this. It is an issue that how other countries can interfere with the help of mere clauses and amount of $1.5bn in our matters and how can we allow them to do so. What is the price of Dr. A.Q Khan? What is the price? It is only $1.5hn? Is it going to be $7bn? Let us discuss it clause by clause. The Government of Pakistan is continuing to cooperate with the United State and efforts to dismantle supply networks …………. This issue has been ended with IAEA certification in 2006, now there is no reason to start this debate again.

Marvi Memon: so, therefore, this excuse cannot be accepted that the direct access to Dr. A.Q Khan and many other will not be given, just because they say so. This is not acceptable. Second thing which is most important as far as nuclear program is concerned is that we need to bring few amendments in our constitution. Here many experience lawmakers are sitting can they tell me is there any clause relating to this issue in our constitution because I tried to find one but I could not find any. If there is no such clause then perhaps this is the time that we should put one such clause in Article 6 as clause (4). Any person conspires to damage the nuclear program by collaborating with foreign forces shall be guilty of high treason. May be it is about time to put that because this is Pakistan’s defense, this is Pakistan’s nuclear program and we will not allow any one any foreign force to interfere with it.  I now come to a very important point. We have been criticizing India for the last so many months and years as far as I have been in this assembly on record being criticizing Indian destabilization efforts in Pakistan for so many moths now. The only thing I want to say right now about India is that at least Indian parliamentarians and Indian Government was told by their parliamentarians in no two easy but in very clear words that they need to have an independent foreign policy and I want to quote that as far as the demand in the Hide Act that India should have foreign policy congruent to that of the United State. They didn’t like word “congruent” even. They said that the expectation that India would join the Proliferation Security Initiative and other demands reveal how the United State expect India to conform as an ally. Their sovereignty standards are so high they didn’t accept even this. Our sovereignty standards should be high like this, at least my party has such standards and I am proud of it. I would like to discuss issue of ISPR press release and I would like to read it out, for the first time a formal input is being provided to the government and it is there in all newspapers. What is the meaning of Zardari being strongly behind Kerry-Lugar Bill despite that formal input, which is military input, which is a defense related input? If they still ignore this input then this is very very serious, serious defense issue and this defense issue means that either the Presidency does not understand the military technical input or they are on some other vested interest align and this is something which Pakistan Muslim League will not accept. We want to understand what is that formal input. We have already understood. We can read these clauses. Anyone can understand that this bill has many serious reservations as far as the security of Pakistan is concerned. We have already been taunted on IMF support, I would like to tell you that it was PML which took the nation out of IMF clutches and PPP has once again put this nation into such condition, so please don’t tell us about IMF. And I also think, Paterson Sahiba has admitted today that there are mistakes. So, we also would like to discuss those mistakes should be allowed to be going forward. Now how is it that the Presidency and I think that there is fair amount of isolation there because the others have not come forward on this, how were they ignoring these mistakes? When they can recognize, the United State’s Ambassador can recognize that there are mistakes and the other leadership of Pakistan People Party is saying that there are no issues and there are no sovereignty concerns and that makes us think as well. I want to now go ahead and try to explain how on sided this entire agreement has been. There has been no mention of Indian and Afghanistan destabilization, there been no mention of the good governance of cooperation. Corruption issues which should have been incorporated in this Bill, and the auditing is so severe that it will definitely be an interference in Pakistan’s governance and we as Pakistan Muslim League are not willing to accept. How is that the People Party is willing to accept so much interference in the auditing. There has been no mention of ROZs as well. All these issues should have been mentioned. It was about “Khapy Khapy Khapy Pakistan Khapy” but now it seems Pakistan “Khap hi Jaey” (ruined) it is not acceptable to us. Beside this I would like to say to you that how can they say they are not abide by the conditions when they have accepted this bill. Please we are intelligent Parliamentarians here. When you are going to accept money, obviously the conditionalities are going to be imposed on you. So, how have you accepted the fact that Mr. Obama will be the one who will be deciding regional security? When you talk about regional security and regional efforts, then I just want to quote that yes RAW and MOSSAD will be involved in your entire security plan because it says very clearly to best implement effective counter insurgency and counter terrorism efforts in and near the borders areas of Pakistan and Afghanistan. The other relevant governments and organizations in the region and elsewhere. So, that includes RAW and MOSSAD. I don’t know how anyone who is responsible, who cares about the defense of Pakistan is going to allow something like this to happen. It doesn’t require military input. It requires common sense and a sense of patriotism. So, please don’t give us Tanas about patriotism. Patriotism demands that you do not accept these kinds of clauses in any kind of way, whether you sign off on it or you don’t sign off on it. I also want to say on this point……………

They might remember the words of their leadership. 1976, Secretary of State Kissinger said in cultural tone “ basically I have not come to advice but to warn you, USA has numerous reservations about Pakistan Atomic Program. Therefore, you have no way out except agreeing to what I say. Bhutto Sahib at that point smiled and said and I quote “ Suppose I refuse, then what?” Henry Kissinger became serious. He locked his eyes on Bhutto and stood up deliberately.  I quote “then we will make a horrible example of you”. Bhutto’s face flashed, he stood up, extended his hands towards Kissinger and said “Pakistan can live without the US help. Now your people will have to find some other ally in this region”. Bhutto Sahib then turned and went out. This is what your leadership did. In 1976, it seems to me, you have forgotten you own leadership. If you are willing to even consider any clauses which effect sovereignty, the defense, the nuclear program, specifically the nuclear program and they accept that Pakistan has been doing state at all that Jawaz terrorism in the past, then you have no, no when the Indian Prime Minister stands up and gives you Tanas that you are the one who is doing state terrorism, then you at that point can have no diplomatic recourse. You have cut all you diplomatic recourse. Please call back your Foreign Minister and not just the talk to your diplomats…………….

Marvi Memon: If the Prime Minister is sitting here, we have absolutely no moral right now to accuse the Indians when the Indians accuse you of state terrorism because you have accepted the clause completely because it says over there seizing support. So, the meaning you accept the word seizing support including ay elements within Pakistan Military or its intelligence agencies to extremist and terrorist groups, you have given a way the only oral high ground that you ever hand this is most irresponsible, dangerous and pretty much. I want to go back to that Article 6 (4) that if you going to assert the sovereignty, the defense and the nuclear program, then there should be a clause added to the constitution which amends the constitution which says that is as bad as high treason. We were taunted that there was no need of constitutional amendment; Article 6 is all ready there. You couldn’t move it against President Musharaf, it’s a different issue. But may be it’s the right time that we should bring another clause in it because when your nuclear programme is being affected then situation gets out of control. Present position of civil and military is very serious situation. This bill makes it worse. There is clause at the end……………..

Marvi Memon: I am just winding up, Speaker Sahib. There is a clause at the end which fuels the civil-military divides. We will not accept any clauses that fuels the military and civil divide. We have enough issues. We need to resolve them on our own. But, any clauses which fuel the civil-military divide should no be acceptable to any democratic government. You claim that you are a democratic government, but frankly you have not shown the character of a democratic government because the democratic government would not have sold out for peanuts or for a lot of money and you certainly have sold out, it seems because anyone who accepts the Kerry-Lugar Bill in its current conditionalities is selling out on the sovereignty, the defense and the nuclear programme and should be held liable for high treason.  Thank you very much.

Marvi Memon: Thank you Honorable Speaker Sahib, first thing, we condemn the attack on the GHQ. What happened on Saturday has never happened in the history of this country. It is very serous what happened on Saturday. And, of course, there is a common perception in the masses that there is a link between what happened on Saturday and Kerry-Lugar Bill, rejection by the military of the Kerry-Lugar Bill. I don’t want to say more that that. I am just saying that the common perception in the masses that this is the decay, the rest I think we can all have our own opinion on this. All I want to say is that we are very proud of our military, the way they have fourth back the terrorists on that particular day. I want to move on and I want to discuss the fact that Foreign Minister has left to the United State and he has not taken any of the notes which have given in terms of the clauses which are completely unacceptable in terms of the Kerry-Lugar Bill. There are certain lethal clauses in the Kerry-Lugar Bill which are detrimental to the National Security of Pakistan. And I would like to understand what notes have been taken on behalf of the Parliament to the Untied States. Because we understand what there is a dead-line on that Bill of 10 days, 10 working days and after which even if President Obama does not comment on it, that Bill will become an Act or that Bill will be and Act as per the law. So, we want to understand what he has taken. Because we would have wanted to give very definite clauses which are very detrimental to our national security. I also want to mention the fact that the Black Water and Dyno Crop and other agencies which are seen to be functioning in Pakistan. We would like to discuss that . my parliamentary leader Faisal Saleh Hayat and other members of Pakistan Muslim League, including Ameer Muqam Sahib, Bushra Rehman Sahibah and Hymayun Saifullah Sahib and myself have moved an adjournment motion. We wish to discuss Dyna Corp. We wish to discuss whether the Deputy Mission the United States officials statement on this is the accurate one that it ahs been disbanded. If there are 200 or many more Dyna Corp types or Black Water types or any other American security agencies roaming around Islamabad or any of our other cities. We want to understand who they are, what the number is and what exactly is their status. We also want to understand what was in the letter that Mr. Hussain Haqqani sent to the Foreign Office which discussed the visa situation. We have not been given a clarification and why visas have been allowed to the security agencies of the United States in Pakistan. I also want to state that this point, that is a very serious issue. We would like to discuss it, perhaps tomorrow and want an answer from Interior Minister as to what this is. Last, but not the lease, it seems to me that Article 6 is yet again on the speeches of the various political parties here. If they have to do anything about Article 6, they would have done it. Clearly, they have not done it, because they don’t have the power to do anything about Article 6. as far as General Pervez Musharraf is concerned, therefore- wasting time- discussing it, and giving long lectures as far as Article 6 is concerned, is considered to be a waste of time of this parliament. KLB ‘explanatory statement’ not a lethality reduction document: Marvi Memon

The explanatory statement has no legal validity infront of the bill which will become law. Even if it did have a legal validity, it does not reduce the lethal aspects of the bill.

The most controversial clause in the bill which pertain to giving US ‘direct access to Pakistani nationals associated with such networks’. The explanation given in the note is unacceptable because it wants ‘cooperative efforts’ to combat proliferation to continue. This cooperation mentioned is intrusive since it demands ‘direct access’.

Pakistan is a responsible nuclear state and doesn’t wish to proliferate ever, but this does not mean that we agree to this kind of sharing of information. Moreover further nuclear expansion is curtailed since reallocation of Pakistan’s financial resources will not be allowed.

The next lethal clause refers to Pakistan accepting that our military and intelligence agencies had in the past given support to terrorist organizations. The explanatory note does not delete this admission. No state can accept a clause which holds it liable to promoting state terrorism. This would be highly irresponsible for any government to accept and would open the doors for further accusations from India.

The other issue pertains to the fact that President Obama’s regional security strategy will include working with ‘relevant governments and organizations in the region and elsewhere.’ Nowhere in the explanatory note is this deleted; infact it is re-inforced because it states that the section is meant to develop a ‘regional security plan for how the United States can best work with its partners.’

It is exactly this kind of regional strategy which will be lethal for Pakistan’s national security interests since it could include RAW/ MOSSAD and many other unfriendly type of organizationss.

These are only a few examples in the KLB explanatory note which continue to make KLB lethal. Therefore patriotic Pakistanis cannot truly accept that the KLB will not ‘dictate the national policy or impinge on the sovereignty of Pakistan in any way’.

It is also not clear how these are not considered to be conditionalities for aid. The aid will stop if cooperation on nuclear proliferation access is demanded and not given. The aid will stop if the regional security strategy so desired by the US is not implemented by Pakistan.

Pakistan needs the aid but not at the cost of our independence. As such the aid coming through the KLB needs to be rejected in totality or else Pakistanis will be held hostage to US micromanagement and interference not just in this government’s tenure but also in the future.
